Regulations Governing Application for License and Declaration for the Manufacturing of Optical Disks

Article 1

These Regulations are enacted in accordance with the provisions of Paragraph 3, Article 4 of the Optical Disk Law (the 'Law').

Article 2

No business entity may manufacture pre-recorded optical disks unless it has applied for and received a license for manufacturing such disks in accordance with these Regulations.

A business entity that intends to manufacture blank optical disks shall file a declaration with the competent authority in advance.

Article 3

Where a business entity that manufactures pre-recorded optical disks has two or more manufacturing premises, it shall apply for a manufacturing license for each premise, and shall display the license at a conspicuous place in the premise manufacturing such disks.

Article 4

When a business entity applies for a license for manufacturing pre-recorded optical disks or files a declaration for manufacturing blank optical disks, it shall submit the request or the declaration to the competent authority or to the administrative agency appointed, entrusted or engaged by such authority.

Article 5

When applying for a license for manufacturing pre-recorded optical disks, a business entity shall submit the following documents:

1. A written application;

2. Photocopies of the front and the reverse sides of the ID card of the responsible person of the applicant business entity, or if the responsible person is an alien, a photocopy of his/her personal identity certificate stating his/her domicile or residence;

3. Photocopies of the front and the reverse sides of the ID card of the responsible person of the manufacturing premise of optical disks, or if the responsible person is an alien, a photocopy of his/her personal identity certificate stating his/her domicile or residence;

4. An affidavit of the responsible person of the applicant business entity, certifying that the responsible person has not committed any of the wrongdoings as set forth in Item 1, Article 5 of the Law;

5. A plan of manufacture for pre-recorded optical disks; and

6. One photocopy each of the company license, the profit-seeking business entity registration certificate, the certificate of incorporation, or other documents sufficient to serve as proof.

Article 6

After the competent authority has examined the documents mentioned in the preceding Article and considered the documents true and correct, it shall issue to an applicant business entity a license for manufacturing pre-recorded optical disks.

After issuing a license, the competent authority shall seek verification from the office of the prosecutor of the information on whether the responsible person of the business entity to which the license has been issued has committed any of the wrongdoings as set forth in Item 1, Article 5 of the Law.

Article 7

When filing a declaration for the manufacturing of blank optical disks, an business entity shall submit the following documents:

1. A written declaration; and

2. One photocopy each of the company license, the profit-seeking business entity registration certificate, the certificate of incorporation, or other documents sufficient to serve as proof.

Article 8

In case a business entity having a license for manufacturing pre-recorded optical disks intends to change certain operations as set forth in Items 2 through Item 5, Paragraph 1, Article 6 of the Law, it shall submit a written application for approval of the changes in advance.

Article 9

In case the responsible person of a business entity or his/her domicile or residence, or the responsible person of its manufacturing premise, or his/her domicile or residence has been changed, the business entity shall submit the following documents to apply for a new license for manufacturing pre-recorded optical disks, within fifteen (15) days upon receipt of a certificate for said changes:

1. A written application for issuance of a new license;

2. A photocopy of the approval of the changes;

3. Photocopies of the front and the reverse sides of the ID card of the responsible person of the business entity or the manufacturing premise after the change, or if the responsible person is an alien, a photocopy of his/her personal identity certificate stating his/her domicile or residence;

4. An affidavit of the new responsible person of the business entity after the change, certifying that the responsible person has not committed any of the wrongdoings as set forth in Item 1, Article 5 of the Law; and

5. A photocopy of the license originally issued for manufacturing pre-recorded optical disks.

Article 10

To change its name, business place, or the address of its manufacturing premise(s) of optical disks, a business entity shall submit the following documents to apply for issuance of a new license for manufacturing pre-recorded optical disks, within fifteen (15) days upon receipt of a certificate for said changes:

1. A written application for issuance of a new license;

2. A photocopy of the approval of the changes;

3. One photocopy each of the company license, the profit-seeking business entity registration certificate, the certificate of incorporation, or other documents sufficient to serve as proof; and

4. A photocopy of the license originally issued for manufacturing pre-recorded optical disks.

Article 11

In the event that a business entity has been manufacturing pre-recorded optical disks before the Law came into force, the business entity shall submit the following documents so as to receive a license for the manufacturing, within six (6) months from the enforcement date of the Law:

1. A written application;

2. Photocopies of the front and the reverse sides of the ID card of the responsible person of the business entity, or if the responsible person is an alien, a photocopy of his/her personal identity certificate stating his/her domicile or residence;

3. Photocopies of the front and the reverse sides of the ID card of the responsible person of the manufacturing premise of optical disks, or if the responsible person is an alien, a photocopy of his/her personal identity certificate stating his/her domicile or residence;

4. One photocopy each of the company license, the profit-seeking business entity registration certificate, the certificate of incorporation, or other documents sufficient to serve as proof; and

5. A document certifying that the business entity has been manufacturing pre-recorded optical disks before the enforcement of the Law.

Article 12

In the event that a business entity has been manufacturing blank optical disks before the Law came into effect, the business entity shall submit the following documents to declare its manufacturing of blank optical disks, within six (6) months from the enforcement date of the Law:

1. A written declaration;

2. One photocopy each of the company license, the profit-seeking business entity registration certificate, the certificate of incorporation, or other documents sufficient to serve as proof; and

3. A document certifying that the business entity has been manufacturing blank optical disks before the enforcement of the Law.

Article 13

The forms of the written application, declaration, plan, affidavit, change application, and application for issuance of a new license as referred to in these Regulations, shall be formulated by the competent authority.

Article 14

These Regulations shall come into effect on the date of promulgation.
